These Terms of Service ("Terms") govern your use of Katika Web Services ("we," "our," or "us") and all related products and services. By accessing or using our services, you agree to be bound by these Terms.

1. Service Description

Katika Web Services provides web hosting, domain name registration and management, email hosting, AI infrastructure hosting, and related services. Specific features, resources, and limitations for each service tier are described on our website and in the applicable service plan documentation.

2. Account Registration

To use our services, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breaches
• Ensuring your contact information remains current and accurate

You must be at least 18 years of age to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Payment Terms

• All prices are listed in US Dollars (USD) unless otherwise stated
• Payment is due at the time of purchase or renewal
• Hosting and email services are billed on a recurring basis (monthly or annually) as selected at purchase
• Domain registrations are billed for the registration period selected (1-10 years)
• We reserve the right to change pricing with 30 days' advance notice
• Refunds are available within 30 days of initial purchase for hosting services, except for domain registrations, which are non-refundable once processed
• Late or failed payments may result in service suspension

4. Acceptable Use Policy

You agree not to use our services to:

• Host, distribute, or transmit malware, viruses, or malicious code
• Send unsolicited bulk email (spam) or phishing communications
• Host content that infringes on intellectual property rights
• Engage in activities that are illegal under applicable law
• Attempt to gain unauthorized access to other systems or networks
• Use excessive server resources that degrade service for other users
• Host content promoting violence, hate speech, or illegal activities

Violation of this Acceptable Use Policy may result in immediate service suspension or termination without refund.

5. Intellectual Property

You retain ownership of all content you upload, create, or store using our services. By using our services, you grant us a limited license to host, store, and transmit your content solely for the purpose of providing the services you have purchased.

The Katika Web Services name, logo, website design, and proprietary software are our intellectual property and may not be used without written permission.

6. Limitation of Liability

To the maximum extent permitted by law:

• Our services are provided "as is" without warranties of any kind, express or implied
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability for any claim shall not exceed the amount paid by you for the affected service in the 12 months preceding the claim
• We are not responsible for data loss; you are responsible for maintaining your own backups

7. Service Level Agreement

We strive to maintain 99.9% uptime for all hosting services. In the event of downtime exceeding this threshold in a given calendar month:

• 99.0% - 99.9% uptime: 10% service credit
• 95.0% - 99.0% uptime: 25% service credit
• Below 95.0% uptime: 50% service credit

Service credits must be requested within 30 days of the affected month. Scheduled maintenance windows, force majeure events, and issues caused by customer actions are excluded from uptime calculations.

8. Termination

Either party may terminate services:

• By you: Cancel at any time through your Client Area or by contacting support. Active prepaid periods will not be refunded unless within the 30-day refund window.
• By us: We may terminate or suspend your account for violations of these Terms, non-payment, or at our discretion with 30 days' notice.

Upon termination, you are responsible for backing up your data before the end of your service period. We may delete account data 30 days after termination.

9. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on our website at least 30 days before taking effect. Your continued use of our services after such changes constitutes acceptance of the updated Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration, except where prohibited by law.
